According to reports, after hearing the arguments by defense and prosecution, Justice JP Singh found as inadequate the evidence produced by the police to make Dar apt to be booked under the Act which is witnessing no trial for two years.
Subsequently, the court quashed the PSA against Dar and directed authorities to release him forthwith provisional to his non-requirement in any other case.
President of Kashmir High Court Bar Association, Mian Abdul Qayoom pleaded the case on behalf of Dar.
Muhammad Ahsan Dar is one of the founders of the Hizbul Mujahideen and was also its first chief commander before being replaced by the incumbent Syed Salahuddin in 1992.
Dar was re-arrested on January 14 this year from Sumbal area in north Kashmir’s Bandipora district.
Ahsan Dar had been arrested first in 1988 but escaped from a hospital and was later arrested in 1993 when he was heading a splinter group of the Hizbul Mujahideen. After remaining in jail for four years, Dar was released in 1997.
According to the police, Dar, a resident of Pattan, rejoined militant ranks again after his release.
